Terms of Service

1. Acceptance of Terms

By accessing or using Dromotelo ("the Service") at dromotelo.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by Orangiraffe, LLC, a Texas limited liability company ("we", "us", "our"). These Terms form a binding agreement between you and Orangiraffe, LLC.

2. Description of Service

Dromotelo is a running training platform that generates personalized training plans, tracks workout progress, and integrates with third-party fitness devices and platforms. The Service includes free and paid subscription tiers with different levels of access.

3. Eligibility

You must be at least 13 years old (16 in the EU) to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you confirm you have parental or guardian consent.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@dromotelo.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or attempt to circumvent subscription restrictions.

5. Subscriptions and Payments

Current beta status: Dromotelo is currently in a private, invite-only beta. No payment processing is active and no user is currently billed. Access levels, including full access for beta testers, are granted manually. The terms below describe how subscriptions will work once paid plans launch, and take effect at that time.

Dromotelo offers a free tier and paid subscription plans ("Pro"). Paid subscriptions are billed on a recurring basis (monthly or annually) via our payment processor. By subscribing, you authorize us to charge your payment method on the applicable billing cycle.

Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods except where required by law.

Price changes: We will provide at least 30 days' notice before changing subscription prices. Continued use after the price change takes effect constitutes acceptance.

6. Training Plans and Fitness Disclaimer

Dromotelo does not provide medical advice. Training plans, pace recommendations, and fitness metrics are generated algorithmically for informational and training guidance purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

Before beginning any new exercise program, consult a qualified healthcare professional, particularly if you have any pre-existing health conditions, injuries, or concerns. You assume full responsibility for your own health and safety when following any training plan provided by the Service.

Orangiraffe, LLC is not liable for any injury, illness, or adverse outcome resulting from use of training plans or fitness recommendations generated by the Service.

7. Third-Party Integrations

The Service may connect to third-party platforms including Strava, Garmin Connect, Google Health, Polar, and Intervals.icu. Your use of those platforms is governed by their respective terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.

You grant Dromotelo permission to access and display data from connected third-party accounts solely for the purpose of providing the Service. You may revoke these connections at any time from your account settings.

8. User Content and Data

You retain ownership of any data you upload to the Service, including activity files and personal metrics. By uploading data, you grant Orangiraffe, LLC a limited license to process and display that data for the purpose of providing the Service to you.

We do not sell your data. See our Privacy Policy for full details on how your data is collected, used, and protected.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, scrape, or copy the Service or its training algorithms
• Share, resell, or redistribute subscription access to others
• Upload malicious files or attempt to compromise Service security
• Impersonate another user or misrepresent your identity
• Use automated tools to access the Service in ways that exceed normal usage

10. Intellectual Property

All content, software, training algorithms, proprietary metrics, and branding associated with Dromotelo are the property of Orangiraffe, LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

The metric names Ignis and Drift, the Dromotelo name and logo, and the underlying plan generation methodology are proprietary to Orangiraffe, LLC.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We make no warranty regarding the accuracy or completeness of training plans or fitness metrics.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Orangiraffe, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to physical injury, data loss, or loss of revenue.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms as the Service evolves. If we make material changes, we will notify you by email or in-app notice at least 14 days before the changes take effect. Continued use after that date constitutes acceptance of the updated Terms.

15. Health Data

Dromotelo is a training and fitness-analysis tool, not a medical device or a provider of medical advice. Health and fitness metrics shown in the app are for informational purposes only and should not be relied upon for diagnosis or treatment; consult a qualified professional for medical decisions. You represent that any health data you connect or upload is your own. You may withdraw consent and delete your health data at any time.
